Terms of Service - WallClique
1. Acceptance of Terms
By downloading, installing, or using the WallClique mobile, tablet, and Windows application ("WallClique", "App", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. About WallClique
WallClique is a wallpaper application that provides users with access to a curated collection of high-quality wallpapers, including HD, 4K, and 8K wallpapers, live wallpapers, and premium content.
Important Note: Only the App administrators (Service Provider) can upload wallpapers to the platform. Users cannot upload, share, or distribute any content. Users may only view, download, and set wallpapers for personal use.

3. Eligibility
To use WallClique, you must:
Be at least 13 years of age (or the age of digital consent in your country)
Have the legal capacity to enter into binding agreements
Not be located in a country subject to U.S. trade sanctions
Not be a person prohibited from receiving services under applicable laws
If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.
4. Account Registration
4.1 Account Creation
You may use WallClique without creating an account (guest mode), but certain features (like favorites, premium access) require account registration
When creating an account, you must provide accurate and complete information
You are responsible for maintaining the confidentiality of your login credentials
You are fully responsible for all activities that occur under your account
4.2 Account Security
Notify us immediately of any unauthorized use of your account at contact@wallclique.com
We are not liable for any loss or damage arising from your failure to protect your account
You may not share your account with others
4.3 Account Termination
We reserve the right to suspend or terminate your account if:
You violate these Terms
You provide false information
We suspect fraudulent or abusive activity
Required by law
5. User Conduct (Read-Only Access)
Since WallClique is a read-only platform where only administrators can upload content, you agree that:

✅ Download wallpapers for personal use
✅ Set wallpapers on your devices
✅ Like/favorite wallpapers
✅ Share wallpaper links
✅ Purchase premium subscription
5.2 Prohibited Actions
You may NOT:
❌ Upload, share, or distribute any content to the App
❌ Attempt to upload wallpapers or any media
❌ Reverse engineer, decompile, or modify the App
❌ Use bots, scrapers, or automated tools to access the App
❌ Interfere with the App's functionality
❌ Bypass any security features
❌ Use the App for any illegal purpose
❌ Harass, abuse, or harm other users
❌ Attempt to gain unauthorized access to admin functions
5.3 Reporting Issues
If you encounter any inappropriate content (though unlikely as only admin uploads), please report it to contact@wallclique.com
6. Wallpaper Usage Rights
6.1 Free Wallpapers
Free wallpapers are for personal, non-commercial use only
You may download and set wallpapers on your personal devices
You may NOT redistribute, sell, sublicense, or share the wallpapers
You may NOT use wallpapers for commercial purposes without written permission
You may NOT claim ownership of any wallpaper
6.2 Premium Wallpapers
Premium wallpapers are available only to active premium subscribers
Usage rights are the same as free wallpapers (personal use only)
Premium wallpapers remain our property
Subscription cancellation revokes access to premium wallpapers
Downloaded premium wallpapers may remain on your device but cannot be redistributed
6.3 Commercial Use

6.4 No Upload Rights
You acknowledge and agree that you have no right to upload any content to WallClique. All wallpapers are provided by the Service Provider only.
7. Premium Subscription
7.1 Subscription Plans
WallClique offers various premium subscription plans:

Lifetime Access (where available)
7.2 Pricing and Payment
Prices are clearly displayed in the App
Payments are processed through Google Play Store and Apple App Store
All prices are in your local currency (where applicable)
We reserve the right to change prices with prior notice
7.3 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the period ends
Your payment method will be charged within 24 hours before the current period ends
You can manage auto-renewal in your device's account settings
7.4 Cancellation
You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period
No refunds for partial subscription periods
7.5 Refunds
Refunds are handled according to Google Play and Apple App Store policies
Generally, no refunds for used subscription time
For refund requests, contact your app store support
8. Intellectual Property
8.1 Our Property
The App name, logo, design, source code, and UI are our intellectual property
All wallpapers displayed in the App are either owned by us or used under license
You may not copy, modify, or create derivative works without permission
8.2 Trademarks
"WallClique" and related logos are trademarks of WallClique
You may not use our trademarks without written permission
8.3 Copyright Infringement (DMCA)
If you believe any content on WallClique infringes your copyright, please contact us at:

11. Disclaimer of Warranties
YOUR USE OF THE APP IS AT YOUR SOLE RISK. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that:
The App will meet your requirements
The App will be uninterrupted, timely, secure, or error-free
The results obtained from the App will be accurate or reliable
Any errors in the App will be corrected
All wallpapers will be available at all times
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLCLIQUE SHALL NOT BE LIABLE FOR:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Personal injury or property damage
Unauthorized access to or alteration of your transmissions or data
Damages resulting from inability to use the App due to lack of internet connection
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR $50 (USD), WHICHEVER IS LESS.
13. Indemnification
You agree to indemnify and hold WallClique harmless from any claims, damages, losses, liabilities, costs, and expenses arising from:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Unauthorized actions performed through your account
14. Device and Network Responsibility
You are responsible for maintaining your device's battery charge
You are responsible for any data charges incurred from your mobile network provider
You are responsible for roaming data charges if using the App outside your home territory
If you are not the bill payer, you confirm you have obtained permission to use the App
14.1 Device Security
Do not jailbreak or root your device
Jailbreaking/rooting removes security restrictions and may cause the App to malfunction
We are not responsible for issues arising from modified devices
15. Modifications to Terms
We may modify these Terms at any time. If we make material changes:
We will notify you through the App or via email
Your continued use of the App constitutes acceptance of the modified Terms
If you disagree with the changes, you must stop using the App
16. Termination
We may terminate or suspend your access immediately, without notice, for:
Violation of these Terms
Fraudulent or illegal activity
Request by law enforcement
Upon termination:
Your right to use the App stops immediately
Premium subscriptions will not be refunded
Some data may be retained as required by law
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in India.
18. Dispute Resolution
18.1 Informal Resolution

18.2 Binding Arbitration
If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration in accordance with Indian arbitration laws.
18.3 Class Action Waiver
YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and WallClique regarding the App and supersede all prior agreements and understandings.

All wallpapers and content are provided exclusively by the Service Provider (Administrator)
You have no expectation or right to upload content to the App
Any attempt to upload content may result in immediate account termination
By using WallClique, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
